Personal interests

Marlene practises in superannuation, financial services and anti-money laundering and counter-terrorism financing law.

Marlene has extensive experience advising employers and superannuation fund trustees on superannuation matters. She also advises more broadly on Australian financial services licensing aspects of the Corporations legislation, as well as advising financial services providers on all aspects of the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and associated legislation.

Prior to joining Lander & Rogers, Marlene worked for a large Australian-based international law firm as part of a speciality superannuation and financial services team.

Marlene's areas of expertise include:

  • the Australian financial services licensing and disclosure aspects of the Corporations Act, including member communications; 
  • anti-money laundering and counter terrorism financing laws; 
  • financial services legislation; 
  • the requirements of the Superannuation Industry (Supervision) Act, including RSE licensing; 
  • drafting, reviewing and amending fund documentation; 
  • outsourcing contracts and related negotiations; 
  • dealings with regulators, in particular APRA, ASIC and AUSTRAC, including applications for relief from regulatory requirements; 
  • litigious matters, in particular, complaints against trustees to the Superannuation Complaints Tribunal; 
  • trust law issues; 
  • fund transfers and mergers; 
  • family law superannuation splitting legislation; 
  • superannuation aspects of mergers and acquisitions; and 
  • providing advice in relation to privacy legislation, including the handling of personal information and reviewing the privacy agreements and policies. 

Marlene was admitted to practice in 2007 and joined Lander & Rogers in 2011.

LLB and BLS – La Trobe University
Certificate IV and Dip Financial Services (Superannuation) - ASFA

  • Member of the Law Institute of Victoria, ASFA, Women in Super and Victorian Women Lawyers
  • Secretary of the Melbourne ASFA Legislation Discussion Group
  • Published various articles in industry journals and regularly presents seminars on topics including current issues and developments in relation to employer superannuation obligations, anti-money laundering, and counter terrorism financing regulation
