Welcome to the Spring 2016 edition of the Bulletin.

It certainly has been a busy three months!  The industrial dispute involving the Country Fire Authority (CFA) and the proposed approval of their enterprise agreement has been one of the largest and high profile industrial cases in recent memory.  The Supreme Court proceedings issued in the matter came to an end recently after the VFVB discontinued their application.  Our group acted for the CFA in the dispute.  

In related news, the Federal Government passed into law a new provision in the Fair Work Act 2009 (Cth) which prohibits the Fair Work Commission from approving enterprise agreements that include terms that impact the capacity of volunteer emergency services bodies to properly manage their volunteer operations.

In this edition of the Bulletin we discuss several recent legal developments and helpful tips for employers including:

  • the legalities of gardening leave;
  • the importance of a notice of employee representational rights in the bargaining of an enterprise agreement; and
  • the safety obligations that may pose a risk in the retail supply chain.
