Welcome to the Winter 2016 edition of the Bulletin.

The recent Federal Government election did not indicate any radical changes to industrial relations in the future. We take a closer look at the implications of the election result in the "Hot Issues" section of this Bulletin.

The last quarter has also seen the high profile decision of a Full Bench of the Fair Work Commission in relation to the application by Coles for the approval of its proposed enterprise agreement. The decision of the Full Bench in applying the "Better of Overall Test", and in particular the playing down of the significance of non-financial benefits, will make it harder for employers to have their enterprise agreements approved.

In this edition of the Bulletin we discuss several recent legal developments and helpful tips for employers including:

  • steps to take to prevent workplace bullying;
  • managing employee dismissals after they've publicly criticised their employer;
  • handling pre-employment representations; and
