Catriona Battaglia

Catriona is a commercial litigator with 15 years' experience in practice, advising clients in relation to a variety of insolvency and commercial disputes. Catriona gives pragmatic legal advice in a commercial context.

Experience

Catriona's experience includes property litigation, commercial and contractual disputes and advisory work, and insolvency advice and litigation services, provided to both insolvency practitioners and the companies and individuals dealing with them. This has included:

  • voidable transactions claims
  • insolvent trading claims
  • restructuring
  • public examinations
  • business and asset sales
  • shareholder oppressive conduct disputes
  • contractual disputes
  • PPSA and security disputes
  • applications for removal of administrators
  • declaratory relief for liquidators
  • dealing with complex Ponzi schemes and claims arising, and
  • trust disputes.

Catriona is an active member of Women in Insolvency and Reconstruction Victoria (WIRV), having previously served on multiple subcommittees, and of the Law Institute of Victoria.

Career highlights

Catriona's career highlights include:

  • acting for residents of a "shares to occupy" structured retirement village on a pro bono basis in relation to various claims against the director and manager in multiple jurisdictions including the Supreme Court, and Federal Court for shareholder oppression. This included successful applications to hold the director in contempt of court, which resulted in a term of imprisonment being imposed
  • acting for liquidators in successfully defending applications to have a special purpose liquidator appointed over them by a creditor
  • acting in a complex bankruptcy matter arising from a multimillion dollar Ponzi scheme defending victims of fraud from claims by trustees in bankruptcy
  • acting for liquidators in complex multimillion dollar breach of directors' duties and insolvent trading claims against directors, associates and related entities
  • advising statutory authorities on recovery of environmental clean up costs against numerous sites across Victoria.
