Senior Associate

Mitchell is a Senior Associate in Lander & Rogers' Insurance Law & Litigation team. He has experience acting for a range of major and specialty insurers both within Australia and overseas, advising clients across insurance product areas and industries including resources, energy, transport, construction, health, retail, and leisure.

Experience

Mitchell is a diverse and adaptable practitioner, with particular experience in public and product liability matters, including personal injury and property damage claims, and high-value/ large-loss recoveries.

He regularly assists insurers and their insureds with all aspects of claims management and procedure including litigation strategy, indemnity issues, liability, quantum and reserving, contribution and recovery, and commercial settlement opportunities.

Additionally, Mitchell has prior in-house experience following a secondment to a major national insurer (AAI Limited).

Career highlights

Mitchell's career highlights include:

  • defending a mine operator in a two-week trial before the Dust Diseases Tribunal of NSW in a claim for coal workers’ pneumoconiosis
  • acting for the liability insurer of a large transport company in a high-profile matter involving a traffic incident which caused multiple fatalities and resulted in several nervous shock claims by the victims' family members
  • acting for a liability insurer and its insured in defence of a claim for catastrophic injuries (quadriplegia) for circa $4 million before the Supreme Court of Queensland
  • acting for a private hospital under a large deductible in response to a complex injury claim by a visiting medical officer who sustained scalpel injuries while performing surgery
  • acting for a home and contents insurer in a circa $4 million recovery against a major energy distributor
  • acting for a specialty motor insurer in a large recovery involving total loss of a prime mover and large livestock trailer carrying several thousand dollars in livestock.
