Our class action specialists defend companies and individuals named in representative proceedings across a wide variety of industries, including in relation to:
- consumer claims
- product liability
- property damage
- corporate governance
- shareholder and securities claims
We act as both defence counsel and monitoring counsel.
As monitoring counsel, we engage proactively on behalf of London and local insurers at primary and excess level. We understand how to balance and advance the markets' needs, as well as the complexities of class action claims, including: allocation issues, primary layer relationship with excess layers, association protocols, influencing defendants' strategy and managing defendants' costs and the role of litigation funders.
In our defence counsel practice, we offer insureds and insurers strategic and commercial advice. We leverage our depth of experience in this area to deliver outcomes that minimise financial and reputational impact while maximising protection against new claims. For example, in recent years we have acted in two class actions arising out of the Springwood bushfires in New South Wales, together with a bushfire claim from the Mount Victoria fires. We have also monitored most of the significant bushfire class actions in recent years.
Our work across many of Australia's landmark class actions is well-known, including Australian Wheat Board, Aristocrat, Allco, Bank of Queensland, Centro, Falls Festival, GIO, Great Southern, Gunns, Hastie, ION, Kagara, Media World, Myer, Newcrest, Octaviar, Queensland flood action, Sigma, Vocation and Willmott.
